Terms and Conditions Agreement

1. Definitions

"Organizers" shall mean Bethere Mexico. "Customer" shall mean any person or persons, firm or company, their servants or agents, or contractors applying for and being allotted space or other services. "Contract" shall mean these Terms and Conditions together with the official application form signed for and on behalf of the Organizers and the "Event" shall mean the event stated on the face of the contract or invoice form. "Space" shall mean the area in the Event building applied for by or allotted to the customer.

2. Registration and representation by Education Agents

Registration must be completed by a representative from a Canadian institution. Attendance and representation at the event must be from the registered Canadian institution. When not able to attend in person, the institution will name a designate (agent or other) to represent their school. A designated agent may ONLY represent one participating Canadian institution at any given event. Agent should not promote or brand itself when representing a school, and their buisness cards should only have the school logo.
Alternative delegates or agent representatives are responsible to the institution that engaged their services and must adhere to all event guidelines. Non-adherence may result in the expulsion of the agent from the fair and may affect the institution's future participation in Government of Canada branded events

3. Applications for Space and Allotments

Application for Space must be made on the official Contract, all sections of which must be completed and signed for and on behalf of the Customer and the allotment of Space by the Organizers shall constitute a contract subject to these Terms and Conditions. Charges for space are stated overleaf and may be subject to alteration. The Customer shall occupy the space allocated to him exclusively as notified on the Contract. All booths in a Government of Canada Branded area or pavilion must retain the booth design such as Brand logo visibility in the front and on the side panels with no covering signs on side or top fascia of the booths. Institution table cloths for table tops are permitted but no other signage or branding materials other than that of the institution being represented should be on display (including address or agent contact information). The Customer may not assign, sublet, transfer the space or grant licenses in respect of any part of the space allotted to him nor may he advertise firms who are not a party to the Contract. No promotion for any other school or country is to be displayed in the booth.

4. Abandonment and Limitation

a) In the event of abandonment, postponement or cancellation of the Event for any reason or limitation of the use of the Event premises or of any of the services provided therein resulting from circumstances beyond the control of the Organizers or intervention by an outside authority or by a decision found necessary by the Organizers, the Customer shall have no claim against the Organizers in respect of loss, delay, costs, expenses, monies or damage and the Customer's liability under this Contract shall not be reduced.
b) The Organizers reserve the right to alter the layout of the event in any respect and at any time. Should it be necessary to rearrange the event or transfer it to another location, the Organizers shall be entitled to allot alternative space to the Customer as the Organizers may determine. They will adjust the cost of the space as necessary for the Customer if the space is affected by such alteration but will not be liable to make any further payment or compensation and the Customer will not be entitled to withdraw from the contract.
c) In case the Customer does not take possession of the space by 12 P.M. on the opening day of the Event, the Organizer reserves the right to allot the space to others without refunding the participation charges already paid.

5. Bankruptcy or Liquidation

In the event of the Customer being declared bankrupt or going into voluntary or compulsory liquidation or failing to observe and perform the obligations or make payment under the terms of the Contract, the Customer may be determined to be in breach of the Contract and all monies paid by the Customer shall be forfeited without prejudice to the right of the Organizers to claim for breach of contract.

6. Risks and Insurance

a) All exhibits articles and other property brought into the event hall by the Customer, shall be at the risk of the Customer. The Organizers shall not be responsible for any loss, damage or destruction occasioned by any cause whatsoever.
b) The Customer shall be liable for and agrees to indemnify and keep indemnified the Organizers against any action, liability, costs, claims, expenses, damages and losses (whether loss or profits or otherwise) arising out of any act or omission of whatsoever nature by the Customer within the Event premises.
c) The Customer is requested to bring his own power adapters/converters for a stabilized supply of power to their devices, since the Organizer cannot ensure stabilized power supply at all times.
d) Customers will be fully responsible for any damage done to the premises, furniture and fixtures provided to them, and the decision of the Organizer in this respect will be final.

7. Withdrawal

Without prejudice to the rights and remedies of the Organizers in respect of any breach of the Contract on the Customer's part, the Organizers may at their discretion allow the Customer to withdraw from the Event subject to the following conditions. If the customer gives notice of cancellation within 60 days of commencement of the event, no cancellation will be permitted and the full amount will remain either payable or no refund will be offered on monies previously paid.
The Organizers will confirm the customer's cancelled participation in writing and from that time will have the right to deal with the space in the way the organizers consider best including reallocation to another customer. When payment of the above amount to the Organizers is received, the Contract shall be cancelled and one party shall have no further claim on the other.

8. Changes in Registration

Any request for changes after the registration form has been received, including but not limited to: Hotel registration, Transportation registration, EXPO registration, Stand Assistant Request - within 30 days of commencement of EXPO will incur a US$30.00 fee for each change. Cancellation or withdrawal from EduCanada Events and EduCanada Pavilions at Expo, webinars, and/or virtual fairs will abide by the withdrawal policy listed in section 6 above

9. Additional Services and Charges

The Organizers reserve the right to make additional charges to the Customer equal to any amount charged to them for any services supplied whether specifically ordered or not. The Organizers accept no responsibility for quality or standard or breakdown or failure of any of the services provided for, or in connection with the Event.

10. Media waiver

I give permission to Bethere Mexico to use photographs or video footage of me, taken at an Bethere Mexico event, for Bethere Mexico promotional purposes only.

11. Payments

Payments for the services contained on invoices/remittance advices must be in accordance with the dates specified. Payment in respect of withdrawal as detailed in Clause 6 above or additional charges as detailed in Clause 7 above must be made within 30 days of date of invoice. In the case of non-payment of monies due for space by the contracted date, the Organizers reserve the right to consider the Contract to be cancelled and all monies paid forfeited.

12. Exclusion of Personnel

The Organizers reserve the right to exclude or remove from the Event any person or persons whose presence is or is likely to be undesirable and the organizers may exercise the rights notwithstanding that any person is the servant or agent of the Customer or is otherwise in any way connected with the Customer.

13. Exhibits

a) The exhibits on display must be fair-worthy quality, properly labelled and must comply with the Terms and Conditions of this Contract.
b) Space should not obstruct the view of adjoining spaces nor be operated in any manner objectionable to other Customers. All lighting within the space must be arranged and operated and should not be distracting to adjacent spaces. Phonographs, radios or other sound devices operated in a manner objectionable to Organizers or Other Customers shall be prohibited.

14. Notice

Any notice or other document to be given under these Terms and Conditions shall be in writing and shall be duly given and deemed to have been received by the addressee two working days following the dispatch, if received at or sent by hand or by registered post or by telex, facsimile or other electronic media to the relevant party at the address on the Contract overleaf or such other address as one party may from time to time given by written notice to the other.

15. Cancellation

In the event that the number of applications is not sufficient by 30 days prior to the fair, we reserve the right to cancel the exhibition. Should this occur, we will refund all fees including the deposit, however, we cannot accept any responsibility for any loss incurred by the exhibitor as a result of the cancellation.

16. Governance

The validity, construction and performance of these Terms and Conditions shall be governed by United States law, as appropriate, and shall be subject to the non-exclusive jurisdiction of the Courts of the United States, as appropriate.

17. Agents Participation

This document defines the rules for participation of education agents at branded EduCanada Fairs under the EduCanada brand. These parameters are intended to ensure the integrity of the EduCanada brand and reputation of the participating institutions.

1) No agent can register for a fair. Registration must be completed by a representative from a Canadian institution. If a Canadian institution (or school board) delegates an education agent to participate, they must advise the Embassy of Canada on the registration form. This also applies if a Canadian institution (or school board) invites an education agent to assist it at the fair.

2) Local education agents assisting Canadian institutions at the fair shall not advertise their own services on any of the booth/table decorations. Only the name of the Canadian institution (or school board) shall be displayed on the signage.

3) No promotional material from education agents, including but not limited to, business cards, flyers and brochures, shall be displayed or distributed at the booth/table. Promotional material will be limited to material supplied by the Canadian institution (or school board).

4) Promotional material from non-participating schools or non-Canadian educational jurisdictions is strictly forbidden.

5) Canadian institutions that are represented by their local education agent or that invite their local education agent to assist them at the fairs are required to ensure that education agents fully adhere to these guidelines.

6) Bethere Mexico reserves the right to remove a local education agent from a fair if they do not comply with the rules laid out in this document. Non-adherence may affect the institution's future participation in Government of Canada branded events.

Corresponding discounts will appear in your invoice. If the payment is made AFTER the deadline a second invoice will be sended for the difference.

EDUCATION PROMOTION EVENT AGREEMENT For EduCanada: STUDY IN CANADA-MEXICO 2017-2018



This agreement is for the purpose of defining the financial responsibilities of "Be There Mexico" and in relation to the EduCanada: Fairs in Mexico to take place between September-October 2016 and February 2017.

A) Services Contracted

1. Responsibilities of the Institution:
* The institution agrees to pay in advance for the costs of activities associated with the education tour/fair.
* Payment of the agreed costs will be made at the time of registration as per payment instructions below.
* * Payment must be made before the event takes place and a notification with the wired transfer should be sent to BeThere.
* The institution must cover and arrange its own airfares, hotels, meal and incidental expenses.
* Participants will be responsible to cover costs and make arrangements for their flights and accomodation.
* The institution understands that "BE THERE MEXICO" may hire the services of local service providers in order to provide the services identified in this Agreement.

2. Responsibilities of "BE THERE MEXICO":
* "BE THERE MEXICO" will provide the institution with information regarding schedules, logistics, hotels. Registration costs will cover all education fair activities (unless otherwise noted) detailed in the Agreement.
* "BE THERE MEXICO" will maintain proper accounts and records of expenditures and ensure that the registration costs charged to the institution represent the most cost-effective option for participants.
* "BE THERE MEXICO" will decide the location of booths according to the "Education au/in Canada" brand guidelines and visitors´ convenience.

3. Statement of Work
The funds collected by "BE THERE MEXICO" will be used to finance the logistics and marketing costs for the events, including, but not limited to, advertising, production of promotional material, logistics, venues, or other expenses explicitly detailed related to the delivery of the event.

4. Withdrawal

5. Notification of Changes and registration
Where required, notice will normally be in writing, by e-mail or by signed facsimile.
Any request for changes after the registration form has been received, including but not limited to: Hotel registration, Transportation registration, EXPO registration, Stand Assistant Request - within 30 days of commencement of EXPO will incur a US$30.00 fee for each change. Cancellation or withdrawal from EduCanada Events and EduCanada Pavilions at Expo, webinars, and/or virtual fairs will abide by the withdrawal policy listed in section 6 above.

6. Payment Procedure
When registration has been approved by the Embassy or Consulate, and a copy of the signed last page of the agreement (scanned and emailed) has been received, "BE THERE MEXICO" will collect participation fees and will send the institution an invoice.

7. Method of payment
You will receive the information for the money transfer, when BeThere receive your registration form completed.

IMPORTANT
By sending this registration form the institution is confirming acceptance of the terms of this agreement.
